TERMS & CONDITIONS
These Terms & Conditions constitute a legally binding agreement. By booking, paying a deposit, or participating in
a charter, the booking party confirms they have read, understood, and agree to be bound by these Terms on behalf of
themselves and all guests in their party.

1. BOOKING CONFIRMATION
A booking is not confirmed until:
- Payment of deposit or full amount is received
- Confirmation is issued by Caribbean Girl Luxury Charters
- Dates are offered on a first-come, first-served basis and are not held without a confirmed deposit
We reserve the right to refuse or cancel any booking at our discretion, including for safety or operational reasons.
2. PAYMENTS
- A 50% deposit is required to secure your reservation unless otherwise agreed in writing
- For bookings made more than 6 months in advance, a 25% deposit may be accepted, with an additional 25% due 2 months prior to the charter date
- Full payment must be received and cleared prior to boarding
Payment Timing Requirements:
- Credit card and PayPal payments must be completed at least 5 days prior to departure
- Venmo payments must be completed at least 24 hours prior to departure
- Cash payments may be made at the dock on the day of the charter
- Any payment timing guidance provided in communications does not override the required payment deadlines outlined in these Terms
- It is not the crew’s responsibility to remind you about final payment. Please complete it as instructed and have cash ready for the crew before boarding.
Accepted Payment Methods:
- Credit Card (Stripe) – 4.25% processing fee
- Venmo – No fee when sent between friends; fees may apply if sent as goods & services
- PayPal – 3.25% processing fee (no fee if sent friends & family where applicable)
- Cash – No fees
All processing fees are the responsibility of the client.
Failure to complete payment within required timeframes may result in delays, cancellation, or denial of boarding without refund.

3. PAYMENT DELAYS & DEPARTURE
All payments must be completed prior to boarding.
- Any delays caused by incomplete or pending payment may delay the charter departure
- The charter will still end at the originally scheduled time regardless of delayed departure
- No additional time will be added due to payment-related delays
4. CHARTER EXTENSIONS & RETURN TIME OBLIGATIONS
Additional time may be added during the charter by contacting your tour designer to arrange a payment link. If no
additional time is arranged, the charter will return at the scheduled time. Any delays in returning the vessel beyond
the agreed end time may result in additional fees.
5. PAYMENT & VERIFICATION REQUIREMENTS
All payments are processed securely through Stripe. As part of our fraud prevention and booking verification
procedures, we require accurate customer information at the time of booking.
For all reservations, the following details must be provided: full name, email address, billing address, and phone number. A valid photo ID may also be requested for verification purposes.
If full payment is made within 5 days of the scheduled charter date (and no prior deposit has been made), the payment details must match the individual listed on the invoice. This includes the cardholder’s name, billing address, email address, and any other relevant identifying information associated with the payment method. Additional verification, including photo identification, may be required to confirm that the payment is being made by or on behalf of the invoiced party.
Failure to provide matching or verifiable information may result in delays, additional verification requests, or cancellation of the booking.
If your invoice has already been issued, it is not a problem—we are happy to revise it prior to payment to ensure all details are correct.

6. PAYMENT DISPUTES & CHARGEBACKS
Clients agree not to initiate chargebacks or payment disputes without first contacting the Company to resolve the
matter.
Any chargebacks made in violation of these Terms may be subject to additional fees, and the Company reserves the right to provide these Terms as evidence in dispute resolution.

7. CANCELLATION POLICY
Cancellations are subject to the following:
- More than 6 weeks before charter – Full refund of deposit
- Less than 6 weeks but more than 10 days – Deposit may be applied as credit towards a future charter. No additional payments to balance will be due
- Less than 10 days before charter – No refund on deposit. Remaining balance may still be required. A credit toward a future charter will be offered at our discretion
- All scheduled payment deadlines remain in effect regardless of cancellation eligibility
- No-shows are non-refundable – No refund or credit; full balance remains due
- Medical Emergencies – A future trip credit with proper documentation
- Cancelations due to severe weather warnings and other safety concerns will be rescheduled or refunded at our discretion
- Operational cancellations by owner – A full refund will be issued
All refunds will be issued via the original payment method where possible or by an alternative method determined
by the Company.
The captain has final authority regarding weather and safety decisions.

8. WEATHER & SAFETY CANCELLATIONS
For safety reasons, we may delay, modify, or cancel trips due to:
- Weather conditions
- Sea state
- Mechanical issues
- Safety concerns
In such cases, guests will be offered:
- Rescheduling, or
- Refund (at Company discretion depending on circumstances)
9. PASSENGER REQUIREMENTS
All passengers must:
- Complete and sign a liability waiver before participating in the charter
- Follow all safety instructions from crew
- Act responsibly onboard
- The number of guests must not exceed the agreed and confirmed booking count without prior approval
Failure to comply may result in refusal of boarding or removal without refund.
10. LIABILITY WAIVER REQUIREMENT
All guests are required to review and sign an electronic waiver agreement prior to participating in the charter.
- Each participant must sign individually
- Waivers will be sent electronically following booking confirmation and may be resent as the charter date approaches
- The charter will not commence until all participating members of the party have completed the waiver. Any delays spent reviewing and signing waivers at the scheduled departure time will delay and be deducted from the total charter duration
The waiver includes assumption of risk and release of liability to the fullest extent permitted by law.
11. TIMING & DELAYS
Charters operate on a fixed schedule based on the agreed departure and return times.
- Guests are expected to arrive on time and ready to board
- Delays caused by late arrival, incomplete waivers, or other guest-related factors will reduce the active charter time
- Delays caused by payment issues will also result in reduced charter time
- The charter will still conclude at the originally scheduled end time regardless of delayed departure
12. ONBOARD RULES & VESSEL USE
To ensure safety, comfort, and preservation of the vessel, all guests agree to the following:
- This is a barefoot vessel; shoes must be removed prior to boarding
- Only human waste may be flushed in onboard toilets; no paper products or foreign items
- Smoking is permitted only in designated areas as directed by crew
- Guests may bring additional food and beverages at their own discretion
- Guests are encouraged to apply sunscreen prior to boarding to help protect vessel surfaces — aerosol sunscreen cans are not permitted aboard
- Guests should bring their own towels unless otherwise arranged in advance
Failure to follow onboard rules may result in additional fees or termination of the charter without refund.
13. DAMAGE, CLEANING & FEES
Guests are responsible for any damage or excessive cleaning required as a result of their actions.
This includes, but is not limited to:

- Clogged toilets due to improper use
- Damage to vessel surfaces, upholstery, or equipment
- Excessive staining or mess requiring deep cleaning
Any such costs will be charged to the booking party.
14. ALCOHOL & CONDUCT
Alcohol may be served during certain charters.

- Unsafe, abusive, or disruptive behavior may result in removal without refund
The captain and crew have full authority over onboard safety decisions.
15. MEDIA RELEASE
During the charter, photos and videos may be taken by crew members for operational and promotional purposes.
By participating in the charter, you grant Caribbean Girl Luxury Charters permission to use such media for
marketing, advertising, and business purposes, including on websites and social media platforms.
Guests who do not wish to be included in marketing materials must notify the Company in writing prior to or during the charter. Reasonable efforts will be made to respect such requests.

16. THIRD-PARTY SERVICES
We may visit or interact with third-party providers (e.g., beaches, snorkeling operators, vendors).
We are not responsible for:
- Acts or omissions of third parties
- Their services or safety practices
Participation in third-party activities is at your own risk.
17. PERSONAL BELONGINGS
The Company is not responsible for loss, theft, or damage to personal property.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Caribbean Girl Luxury Charters, its owners, employees, and crew shall not be
liable for any injury, loss, damage, or death arising from participation in charter activities.
19. GOVERNING LAW
These Terms shall be governed by the laws of Saint Lucia, and any disputes shall be subject to the jurisdiction of
Saint Lucia courts.
20. ACCEPTANCE OF TERMS
By making a booking, submitting a deposit, completing payment, or participating in the charter, you acknowledge
and agree that:
- You have read and understood these Terms;
- You accept these Terms on behalf of yourself and, where applicable, all members of your party;
- If you are making a booking on behalf of a group, you represent and warrant that you are authorized to accept these Terms on behalf of all participants;
- You agree to provide all participants with access to these Terms and Conditions and any required waivers, including by distributing or otherwise making them available prior to participation;
- You agree to ensure that all participants review, execute, and comply with these Terms and any required waivers; and
- The booking party assumes responsibility for coordinating compliance with these Terms and all required waivers for all guests in the booking party.
21. GRATUITY
Gratuity is not included in the charter price.
- Tipping is customary within the charter industry
- A standard gratuity of 10–20% of the charter price is typical, based on guest satisfaction
- Gratuities are paid directly to the crew
22. CHARTER EXPERIENCE & ITINERARY
Caribbean Girl Luxury Charters provides private, customizable charter experiences.
- Charter routes, stops, and activities may be customized based on guest preferences, time, and conditions
- All itineraries remain subject to captain approval based on weather, safety, and operational considerations
- The captain retains final authority over all routing and activity decisions
- Changes to itinerary, stops, or activities during the charter do not affect the agreed charter rate
23. ARRIVAL & BOARDING
Guests are responsible for following all provided arrival and boarding instructions.
- Guests must arrive at the designated location on time and ready to board
- Guests may be required to contact crew prior to arrival for coordination
- Failure to follow arrival instructions may result in delays, which will reduce charter time
24. EXCLUSIVE BOOKING
We operate a limited schedule and typically accommodate only one private charter per vessel per day.
This allows for a fully personalized and flexible experience; however, all charters remain subject to agreed timing
and operational constraints.
25. WATER ACTIVITIES
Participation in swimming, snorkeling, cliff jumping, or any water-based activities is voluntary and at the guest’s
own risk.

- The captain may restrict or prohibit any activity deemed unsafe due to conditions or guest behavior
26. FORCE MAJEURE
Caribbean Girl Luxury Charters shall not be liable for failure or delay in performance due to circumstances beyond
its reasonable control, including but not limited to acts of God, government restrictions, port closures, labor disputes,
fuel shortages, or other unforeseen events.
In such cases, charters may be rescheduled or refunded at the Company’s discretion.
27. MINORS
Minors must be accompanied by a parent or legal guardian, who assumes full responsibility for their supervision and
safety.
28. CHANGES TO TERMS
Caribbean Girl Luxury Charters reserves the right to update or modify these Terms & Conditions at any time. The
version of the Terms & Conditions in effect at the time of booking shall apply to that booking. Any updates or
modifications will apply only to future bookings unless required by law or necessary for safety or operational
reasons. In the event that a material change is required prior to a scheduled charter, reasonable efforts will be made
to notify the booking party in advance.
29. SEVERABILITY
If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable in whole or in part under
applicable law, such provision shall be deemed severed to the minimum extent necessary and shall not affect the
validity or enforceability of the remaining provisions.
The remaining provisions shall continue in full force and effect as if these Terms & Conditions had been executed without the invalid or unenforceable provision.
To the fullest extent permitted by law, any such provision shall be interpreted, modified, or limited so as to best accomplish the original intent of the parties in a legally enforceable manner.

30. ENTIRE AGREEMENT
These Terms & Conditions, together with any applicable waiver agreements and booking confirmations, constitute
the entire agreement between the parties and supersede all prior discussions, communications, or agreements,
whether oral or written, relating to the subject matter herein.
