This page provides a preview of the Liability Waiver and Release of Claims required for participation in a Caribbean Girl Luxury Charters experience.

Important: This document is provided for informational purposes only.

A separate, fully binding electronic waiver must be completed and signed by each participant before the charter begins. Participation will not be permitted without completion of the official electronic waiver.

By booking a charter, you acknowledge that you will be required to review and sign the official waiver in advance of your trip.

ACCEPTANCE OF CHARTER TERMS AND CONDITIONS

The official electronic waiver will require you to affirm that you have reviewed and agree to the Charter Terms and Conditions
Participation in the charter is conditioned upon acceptance of the Charter Terms and Conditions. By signing this Waiver, you acknowledge that you have been provided with access to the Charter Terms and Conditions, including via the booking confirmation or by the booking party, and that you have had a reasonable opportunity to review them. You agree to be bound by the Charter Terms and Conditions, which are incorporated herein by reference. If you did not receive or review the Charter Terms and Conditions, you agree that it is your responsibility to request and review them prior to participating in the charter.
This Waiver is intended to be read together with the Charter Terms and Conditions, which are incorporated by reference and form part of the overall agreement between the parties.

1. Voluntary Participation & Assumption of Risk

Participation in a boat charter and related activities (including embarking/disembarking swimming, snorkeling, boarding, and time on or near the water) involves inherent risks, including but not limited to:
  • Slips, falls, and water-related injury
  • Changing weather and sea conditions
  • Vessel movement and marine hazards
  • Interaction with other passengers or third parties
  • Risks associated with swimming and water activities
All participation is voluntary, and guests assume responsibility for these inherent risks.

2. Alcohol & Guest Conduct

Alcohol may be available or consumed during certain charters.
Guests acknowledge:
  • Alcohol may impair judgment and coordination
  • Consumption is at the guest’s own risk
  • The crew may limit or refuse alcohol service at any time
The captain and crew reserve full authority to:
  • Restrict participation in activities
  • Address unsafe or disruptive behavior
  • Remove guests from the vessel if necessary for safety
Removal may result in termination of participation without refund.

3. Third-Party Services & Locations

Charters may include visits to or interaction with third-party providers (such as beaches, vendors, or activity operators).
Caribbean Girl Luxury Charters does not own or control third-party services and is not responsible for their actions, safety practices, or operations.
Participation in any third-party activity is at the guest’s own risk.

4. Personal Responsibility

Guests are responsible for their own safety and conduct at all times, including while boarding, disembarking, and participating in activities.
Personal belongings are brought at the guest’s own risk. The company is not responsible for loss, theft, or damage to personal items.

5. Medical Fitness

Guests are responsible for ensuring they are physically and mentally fit to participate.
In the event of a medical emergency, the company may seek emergency assistance on the guest’s behalf. Any related costs are the responsibility of the guest.

6. Legal Waiver Requirement (Electronic Signature Required)

The official Liability Waiver:
  • Must be completed electronically by each participant
  • Is required before the begins
  • Is legally binding once signed
Failure to complete the waiver will result in denial of boarding.

7. Governing Law

The official waiver (once signed) is governed by the laws of Saint Lucia.

8. Severability

If any provision of the official Liability Waiver and Release of Claims is determined to be invalid, illegal, or
unenforceable under applicable law or by a court of competent jurisdiction, such provision shall be deemed severed from the agreement and shall not affect the validity or enforceability of the remaining provisions.
To the fullest extent permitted by law, any such provision shall be modified and enforced so as to most closely reflect the original intent of the parties while remaining legally enforceable.
