REVIEW – Terms Oct 31

Caribbean GirlLUXURY CHARTERS

TERMS & CONDITIONS

These Terms & Conditions constitute a legally binding agreement. By booking, paying a deposit, or participating in a charter, the booking party confirms they have read, understood, and agree to be bound by these Terms on behalf of themselves and all guests in their party.

  • Last Updated: 5/4/26
  • Company: Caribbean Girl Luxury Charters

1. BOOKING CONFIRMATION

A booking is confirmed when the Company receives the required deposit, or payment in full if you choose to pay in full. Confirmation is effective on receipt of payment — it does not wait for a confirmation email from us. Let us know when your deposit is sent so we can match it to your invoice, update your invoice, and send your official booking confirmation — please allow up to 48 hours for that to reach you. Until a deposit is received, no date is held and no inquiry has priority over another. The Company reserves the right to refuse or cancel any booking, including for safety or operational reasons.

Cash is always welcome and preferred for balances. Depending on the activities and add-ons you have chosen, a portion of your final balance may be required in cash, because some of the local providers for those extras are paid in cash. We will let you know the amount at the time of invoice. A deposit is required to book every charter. If you would like to pay your deposit in cash, we can arrange to meet you near Rodney Bay Marina to collect it.

2. PAYMENTS

  • A 50% deposit is required at the time of booking to secure your reservation.
  • For charters booked more than six months in advance, the deposit may be paid in two parts: 25% at booking, and the remaining 25% two months before the charter date.
  • All prices are stated in US dollars.
  • You are responsible for your payment’s processing fee: 4.2% for credit cards, 3% for Venmo or PayPal with purchase protection turned on. Friends-and-family payments and cash have no fee.

3. PAYMENT DELAYS & DEPARTURE

All payments must be completed prior to boarding.

Charters require a minimum of 72 hours’ notice to book. A booking inside 72 hours may be accepted at the Company’s discretion when availability allows. Short-notice bookings always incur extra charges, carry restricted payment options and restricted add-ons, and always require a deposit.

  • Any delays caused by incomplete or pending payment may delay the charter departure
  • The charter will still end at the originally scheduled time regardless of delayed departure
  • No additional time will be added due to payment-related delays

4. CHARTER EXTENSIONS & RETURN TIME OBLIGATIONS

Additional time may be added during the charter only with the Tour Designer’s approval, and payment must be taken first, on board instantly. If no additional time is arranged, the charter will return at the scheduled time. Any delays in returning the vessel beyond the agreed end time may result in additional fees.

If the vessel returns more than 15 minutes after the scheduled end time, an additional hour is charged. Where a delayed return brings the vessel back at sunset and no sunset return was booked, the sunset return fee of $250 is also charged; a sunset return is complimentary only on charters returning to Rodney Bay. For example, a charter returning to Soufrière that runs an hour late is charged for the additional hour and the $250 sunset return. All such charges are payable on board before any guest leaves the vessel.

A guest’s request to return early does not entitle the guest to a refund for unused charter time.

Additional time beyond the booked charter is charged at $250 per hour.

Guests must be ready to disembark when the vessel docks. Remaining on board after docking — for example, continuing to party instead of disembarking — may be charged as additional time at the hourly rate above.

5. PAYMENT & VERIFICATION REQUIREMENTS

  • Credit and debit card payments must be received at least 5 days before the charter date.
  • Venmo and PayPal payments with purchase protection turned on must also be received at least 5 days before.
  • Venmo and PayPal payments sent friends-and-family may be received the night before the charter.
  • Cash is accepted at the dock before boarding. All balances must be settled and cleared before departure.
  • Inside the 5-day window, the Company may, at its discretion, accept a card or purchase-protection payment once verification is provided: a copy of the payer’s driver’s license, the billing and mailing addresses for the payment method, the email address associated with it, and an invoice issued in the same name as the payment. Acceptance is never guaranteed.
  • Guests are responsible for their payment processing fees, as set out in Section 2.
  • Refunds are issued to the original payment method whenever possible.

6. PAYMENT DISPUTES & CHARGEBACKS

Clients agree not to initiate chargebacks or payment disputes without first contacting the Company to resolve the matter.

Any chargebacks made in violation of these Terms may be subject to additional fees, and the Company reserves the right to provide these Terms as evidence in dispute resolution.

7. CANCELLATION POLICY

If you cancel

  • More than 6 weeks before your charter: full refund of your deposit.
  • Between 10 days and 6 weeks: your deposit becomes a credit toward a future charter.
  • Less than 10 days: no refund of your deposit. Between 7 and 10 days, the remaining balance may still be due; inside 7 days — including the day before and the day of — the remaining balance is due in full. A future credit may be offered at our discretion.
  • All scheduled payment deadlines remain in effect regardless of cancellation eligibility
  • No-shows: no refund or credit, and the full balance remains due.
  • All cancellations must be made by phone. Emails and texts do not count as an official cancellation.

Refunds will not be issued solely on the basis of a guest’s personal preferences, subjective expectations, or opinion of the charter’s quality, provided the booked vessel and contracted services were substantially delivered as described.

All refunds will be issued via the original payment method where possible or by an alternative method determined by the Company.

8. WEATHER & SAFETY CANCELLATIONS

Severe weather warnings

If the Coast Guard issues a severe weather warning and grounds the boats, your charter does not sail. We will offer you another open day; if none of them works for you, you receive a full refund. This applies even inside six weeks.

If we have to cancel

If we cancel your charter — a mechanical problem, or a safety concern on our side — you choose: another open day, or a full refund.

Ordinary bad weather

Rain alone is never a reason to cancel, and no refund is given for weather. We may shift your departure time or your route to work around it. If we can see a truly bad day coming and another day is open, we may offer to move you. Offering is our choice, and we do not publish our availability.

Emergencies

For a medical or similar emergency, with documentation, a future credit or a refund may be given at our discretion. A claim we cannot verify will not be granted.

The captain’s authority

The captain decides safety on the water — where to anchor, and whether activities like cliff jumping or paddleboarding are safe that day. The captain does not decide severe weather warnings. Those come from the Coast Guard.

9. PASSENGER REQUIREMENTS

All passengers must:

  • Complete and sign a liability waiver before participating in the charter
  • Follow all safety instructions from crew
  • Act responsibly onboard
  • The number of guests must not exceed the agreed and confirmed booking count without prior approval

Failure to comply may result in refusal of boarding or removal without refund.

Children under two travel free of charge and count toward the vessel’s maximum of 38 guests.

Your proposal is priced for a guest-count range. Inside that range, the per-person price holds and the total adjusts to your final count, which is due one week before the charter. Counts outside the range may change the per-person price, and a count below the range may require a new proposal. Guests who arrive unannounced are charged before boarding, and waivers must be signed before boarding. Date changes require at least one week’s notice; changes to chef or catering arrangements require at least two weeks’ notice.

10. LIABILITY WAIVER REQUIREMENT

All guests are required to review and sign an electronic waiver agreement prior to participating in the charter.

  • Each participant must sign individually
  • Waivers will be sent electronically following booking confirmation and may be resent as the charter date approaches
  • The charter will not begin, and the vessel will not depart, until all required waivers are signed. At a congested cruise-ship dock, guests may be able to board while signatures are completed, but the vessel hovers — cruising time does not start until every waiver is signed, which may shorten the time spent cruising. Any guest who refuses to sign a waiver may not participate in the charter, and will not be taken back to the dock if already on board.

The waiver includes assumption of risk and release of liability to the fullest extent permitted by law.

11. TIMING & DELAYS

  • Guests are expected to arrive on time and ready to board
  • Delays caused by late arrival, incomplete waivers, or other guest-related factors will reduce the active charter time
  • Delays caused by payment issues will also result in reduced charter time
  • The charter will still conclude at the originally scheduled end time regardless of delayed departure

12. ONBOARD RULES & VESSEL USE

To ensure safety, comfort, and preservation of the vessel, all guests agree to the following:

  • This is a barefoot vessel; shoes must be removed prior to boarding
  • Only human waste may be flushed in onboard toilets; no paper products or foreign items
  • Smoking is permitted only in designated areas as directed by crew
  • Guests may bring additional food and beverages at their own discretion
  • Guests are encouraged to apply sunscreen prior to boarding to help protect vessel surfaces — aerosol sunscreen cans are not permitted aboard
  • Guests should bring their own towels unless otherwise arranged in advance

Failure to follow onboard rules may result in additional fees or termination of the charter without refund.

Outside chefs are not permitted on board. A chef may be arranged only through the Company, and anyone working on board must be certified crew. Guests may bring their own catering: coolers for storing it can be supplied when requested in advance, and the galley is available for rewarming. The crew does not rewarm or serve catering it did not provide, and guests must bring everything needed to serve it — plates, cutlery, and napkins — and be prepared to serve themselves. Guests bringing their own catering are also responsible for cleaning up after it; food or mess left behind in the galley will be charged as additional cleaning at the end of the charter.

13. DAMAGE, CLEANING & FEES

Guests are responsible for any damage or excessive cleaning required as a result of their actions.
This includes, but is not limited to:

  • Clogged toilets due to improper use
  • Damage to vessel surfaces, upholstery, or equipment
  • Excessive staining or mess requiring deep cleaning

Any such costs will be charged to the booking party.

14. ALCOHOL & CONDUCT

Alcohol may be served during certain charters.
Guests agree that:

  • Alcohol consumption is at their own risk
  • The Company may limit or refuse service at any time
  • Unsafe, abusive, or disruptive behavior may result in removal without refund

The captain and crew have full authority over onboard safety decisions.

15. MEDIA RELEASE

During the charter, photos and videos may be taken by crew members for operational and promotional purposes. By participating in the charter, you grant Caribbean Girl Luxury Charters permission to use such media for marketing, advertising, and business purposes, including on websites and social media platforms.
Guests who do not wish to be included in marketing materials must notify the Company in writing prior to or during the charter. Reasonable efforts will be made to respect such requests.

16. THIRD-PARTY SERVICES

We may visit or interact with third-party providers (e.g., beaches, snorkeling operators, vendors). We are not responsible for:

  • Acts or omissions of third parties
  • Their services or safety practices

Participation in third-party activities is at your own risk.

17. PERSONAL BELONGINGS

The Company is not responsible for loss, theft, or damage to personal property.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Caribbean Girl Luxury Charters, its owners, employees, and crew shall not be liable for any injury, loss, damage, or death arising from participation in charter activities.

19. GOVERNING LAW

These Terms shall be governed by the laws of Saint Lucia, and any disputes shall be subject to the jurisdiction of Saint Lucia courts.

20. ACCEPTANCE OF TERMS

By making a booking, submitting a deposit, completing payment, or participating in the charter, you acknowledge and agree that:

  • You have read and understood these Terms;
  • You accept these Terms on behalf of yourself and, where applicable, all members of your party;
  • If you are making a booking on behalf of a group, you represent and warrant that you are authorized to accept these Terms on behalf of all participants;
  • You agree to provide all participants with access to these Terms and Conditions and any required waivers, including by distributing or otherwise making them available prior to participation;
  • You agree to ensure that all participants review, execute, and comply with these Terms and any required waivers; and
  • The booking party assumes responsibility for coordinating compliance with these Terms and all required waivers for all guests in the booking party.

21. GRATUITY

Gratuity is not included in the charter price.

  • Tipping is customary within the charter industry
  • A standard gratuity of 10–20% of the charter price is typical, based on guest satisfaction
  • Gratuities are paid directly to the crew

22. CHARTER EXPERIENCE & ITINERARY

Caribbean Girl Luxury Charters provides private, customizable charter experiences.

  • Charter routes, stops, and activities may be customized based on guest preferences, time, and conditions
  • All itineraries remain subject to captain approval based on weather, safety, and operational considerations
  • The captain retains final authority over all routing and activity decisions
  • Changes among the stops already included in your original itinerary do not change your charter rate. A requested change that adds distance or time — for example, adding the Pitons to a charter that did not include them — is charged accordingly, at the rates set out in Section 4.

This is a private charter, with an itinerary custom-planned with you in advance. Guests may disembark at designated locations included in the itinerary at scheduled times. Safety regulations require passengers to remain with the group during scheduled excursions on shore.

23. ARRIVAL & BOARDING

Guests are responsible for following all provided arrival and boarding instructions.

  • Guests must arrive at the designated location on time and ready to board
  • Guests may be required to contact crew prior to arrival for coordination
  • Failure to follow arrival instructions may result in delays, which will reduce charter time

24. EXCLUSIVE BOOKING

The Company operates a limited schedule built around one private charter per day. This allows the vessel to be professionally cleaned and prepared between charters, and the crew’s full attention given to a single group.

25. WATER ACTIVITIES

Participation in swimming, snorkeling, cliff jumping, or any water-based activities is voluntary and at the guest’s own risk.

  • Guests must follow all crew instructions at all times
  • The captain may restrict or prohibit any activity deemed unsafe due to conditions or guest behavior

26. FORCE MAJEURE

Caribbean Girl Luxury Charters shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, government restrictions, port closures, labor disputes, fuel shortages, or other unforeseen events.

27. MINORS

Minors must be accompanied by a parent or legal guardian, who assumes full responsibility for their supervision and safety.

28. CHANGES TO TERMS

Caribbean Girl Luxury Charters reserves the right to update or modify these Terms & Conditions at any time. The version of the Terms & Conditions in effect at the time of booking shall apply to that booking. Any updates or modifications will apply only to future bookings unless required by law or necessary for safety or operational reasons. In the event that a material change is required prior to a scheduled charter, reasonable efforts will be made to notify the booking party in advance.

29. SEVERABILITY

If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable in whole or in part under applicable law, such provision shall be deemed severed to the minimum extent necessary and shall not affect the validity or enforceability of the remaining provisions.

The remaining provisions shall continue in full force and effect as if these Terms & Conditions had been executed without the invalid or unenforceable provision.

To the fullest extent permitted by law, any such provision shall be interpreted, modified, or limited so as to best accomplish the original intent of the parties in a legally enforceable manner.

30. ENTIRE AGREEMENT

These Terms & Conditions, together with any applicable waiver agreements and booking confirmations, constitute
the entire agreement between the parties and supersede all prior discussions, communications, or agreements,
whether oral or written, relating to the subject matter herein.

31. PROMOTIONAL PRICING & DISCOUNTS

Promotional pricing in a proposal is honored for 14 days from the date of the proposal. After 14 days, the proposal is priced at current rates and subject to availability, and a new proposal will be issued. Early-booking and quick-booking discounts are offered in writing with a stated deadline for the deposit; if the deposit is not received by that deadline, the discount expires and the charter price may change.
